This Waiver and Release of Liability (the "Waiver") is made by the undersigned participant (or parent/guardian, if the participant is a minor) in favor of 1001116038 ONTARIO INC. operating as Bella Aquatics Swim School and its owners, directors, employees, instructors, agents, and affiliates (collectively referred to as “Bella Aquatics Swim School” below).
Acknowledgment and Assumption of Risk
By signing this Waiver, I acknowledge and agree as follows:
I understand that participating in swimming lessons, aquatic activities, or other related activities involves inherent risks, including but not limited to physical injuries, drowning, allergic reactions, or other unforeseen incidents.
I voluntarily assume all risks associated with participation in swim school activities, whether supervised or unsupervised, on or off Bella Aquatics Swim School premises.add other locatons
Release of Liability
To the fullest extent permitted by law:
I release and discharge Bella Aquatics Swim School from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may occur as a result of participation in Bella Aquatics Swim School activities.
This release includes claims based on the negligence of the Swim School, its employees, or agents.
Indemnification
I agree to indemnify and hold harmless Bella Aquatics Swim School against any and all claims, demands, damages, costs, or expenses (including legal fees) arising out of or in connection with participation in Bella Aquatics Swim School activities.
Medical Consent
I confirm that the participant(s) is/are in good health and physically capable of participating in swimming activities.
I authorize Bella Aquatics Swim School to administer or arrange for emergency medical care in the event of an injury or medical condition, and I agree to bear any associated costs.
Use of Photographs and Videos
I grant Bella Aquatics Swim School permission to use photographs, videos, or other media taken during lessons or events for promotional, educational, or other purposes, without compensation. If I do not agree to this clause, I will notify Bella Aquatics Swim School in writing.
Governing Law
This Waiver is governed by the laws of the Province of Ontario, and any disputes arising out of this Waiver shall be resolved in Ontario courts.
Acknowledgment of Understanding
I have read and understood this Waiver, and I sign it freely and voluntarily.
If signing on behalf of a minor, I certify that I am the legal parent or guardian and have full authority to sign this Waiver on their behalf.
